Tom Fiello, LLC (“Company”) warrants its custom hardwood stair treads (“Product”) to be free from defects in material and workmanship under normal use and service for a period of five (5) years from the date of purchase. This warranty is valid only for the original purchaser who owns and occupies the residential dwelling where the Product is installed, and is not transferable.

This warranty is expressly limited to residential owner-occupied dwellings, and does not apply to any installation or use in rental properties, commercial properties, or other non-residential properties.

If any defect in material or workmanship occurs during the warranty period, the Company will, at its option, either repair or replace the defective Product or refund the purchase price paid by the original purchaser. This remedy is the sole and exclusive remedy for any breach of warranty.

This warranty does not cover damage caused by improper installation, improper maintenance, normal wear and tear, accidents, misuse, abuse, or any other cause beyond the Company’s control. The warranty also does not cover variations in color, grain, or texture, which are natural characteristics of hardwood.

To make a claim under this warranty, the original purchaser must notify the Company in writing within thirty (30) days of discovering the defect and provide proof of purchase. The Company may require the original purchaser to return the defective Product for inspection before honoring any warranty claim.

This warranty is in lieu of all other warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. The Company shall not be liable for any incidental, consequential, or punitive damages arising out of the use or inability to use the Product.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

This warranty is governed by the laws of the State of Florida, and any disputes arising under this warranty shall be resolved exclusively in the state or federal courts located in Volusia County, Florida.
